The Story about this TAC Claim
Ms D came to us after a motor vehicle accident in which she was a driver and another car cut across her path causing a collision. Ms D could not avoid the other vehicle and suffered serious injuries when her body collided with the steering wheel of her car — she sustained multiple fractures, including her sternum, collar bone and several fractures to the fingers on her right hand. Our client was also left with a permanent lump on her collar bone and required several operations on her right (dominant) hand, leaving her with 7 metal screws permanently in place in her little finger.
Although Ms D was able to continue at work, her hobbies were affected, especially arts and crafts needing fine skills with her right hand. We successfully negotiated a significant common law settlement for Ms D without the need for court proceedings.
We were also successful in challenging TAC’s decision to cease funding her hand therapy, by making an application to VCAT and having that decision revoked, and meaning that her treatment will continue into the future.
