The Story about this TAC Claim
Prior to her transport accident Yafan was a happy and outgoing lady, often playing musical instruments with friends and dancing at events. Since her accident she has been in significant pain and has sought the assistance of numerous treaters. Due to the extent of her injuries she has spent a lot of her time at specialists and travelling from medical appointment to medical appointment. Yafan was very dedicated and worked hard to get back to her pre-injury condition. She did not like being dependent on others and felt that she burdened her family.
Yafan contacted our office and explained her situation, she also explained that she has difficult travelling. We understood the situation and organised for home visits for Yafan. We advised her to focus on her recovery and health and we would work on her TAC common law claim. We kept Yafan informed of the status of her claim and encouraged her to seek benefits from TAC. We explained the TAC has a obligations to assist her and to liaise with her treating doctors on what may benefit her.
After examinations with numerous specialists, and just before the two year anniversary of her accident Yafan obtained a serious injury certificate, granting her permission to seek common law compensation. We organised for a conference with the TAC and resolved her claim for an amount in the very high range for pain and suffering.
Yafan was very grateful for our services and provided the below testimonial.
Actual Client Testimonial.
On 26 December 2016, my husband and I were driving home after Christmas shopping. I was wearing the seatbelt and fell asleep at the rear passenger seat. When we travelled to the corner of Queens Way and St Kilda Road, due to the weather change, my husband was swapping his sun glasses to prescription glasses. Our car lost control and crashed into a tree. Shortly after I was taken out of the car, I felt pain all over my body then I fainted. When I next time woke up, I found I was in the hospital ICU and covered in tubes. I was told by doctor that I suffered severe injuries including fractures of the neck, lumbar vertebrae & thoracic vertebrae, neck vein rupture, spleen rupture, intestine rupture and a torn abdomen. I was lucky to be alive. I was also told by the doctor, with the injuries I suffered I should seek compensation from the TAC. I thought that the accident was caused by my husband, I could not believe I was able to get compensation. After I discharged from the hospital, TAC was very responsible and helpful. They funded all relevant medical treatments and rehab programs. I was more confused as how I was able to ask for compensation. I was focusing on my treatment and recovery. I was told at various occasion that the compensation will help me with the rest of my life and I should pursue it. We are new migrants and not familiar with the legal system here in Australia. Due to the past experience, we were afraid of seeking assistance from lawyers. On one occasion, I heard HCA lawyers on radio, sharing successful cases and relevant legislations. I noted that they offer no win no fee arrangement to help injured person seeking compensation. I made contact with them, they analysed my case and explained my legal rights. More importantly, they assured me of the “no win no fee” offer. ……HCA lawyers continued act on my behalf, answered all my questions and acted on the best of my interests. They were dedicated to help me with my case, never put me off …..My case was close to the third anniversary, I was grateful to all the assistance and help received. I am glad that my compensation claim had been managed in a professional way and approached the settlement. HCA lawyers, not just keeping their “no win no fee“ promise but charges reasonable legal costs. This is really a safe harbor for us, all disabled people due to car accidents. On behalf of my family, I would like to thank all the staff of HCA law firm for their hard work and excellent result achieved.
