The Story about this Public Liability Claim
Our client, Katrina, came to us after a trip and fall accident on a footpath where the grout had eroded between a paver and a telecommunications pit lid. The accident occurred on a very busy street that Katrina and her friends were walking along on their way back to the car after seeing a theatre show. The toe of Katrina’s boot became stuck in the hole left by the missing grout. She fell forward onto her outstretched hands and suffered significant injuries to her hands, wrists and both shoulders.
At the time of the accident Katrina was self-employed, and her job involved working very long hours typing at her computer all day. Her injuries were a disaster for her as she was unable to keep to deadlines for important projects, and ultimately she had to close down her business due to her inability to type. Katrina’s claim was also complicated as there were a number of defendants, including the local council, a telecommunications company, and various sub-contractors who all denied liability for the incident. Eventually, we were able to settle Katrina’s matter at a mediation for significant compensation only a few weeks before trial.
