The Story about this WorkCover Claim
Karina was employed as an activities coordinator. Her employer thought because she was young, fit and healthy they could ask her to do a task outside of her normal job description without training or sufficient instructions. Unfortunately whilst doing this task Katrina suffered an injury. Her injury was caused by her employer not instructing her properly on what they considered to be an easy job. We felt the employer had breached the Victorian Occupational Health and Safety Regulations which provide that every employer must provide appropriate equipment and/or training to their employees. Due to her injury Karina suffered back pain – so much pain that she had to give up the career she had loved and trained for and find alternative employment. She continues to experience pain and is now unable to do all the activities she enjoyed prior to her accident. Because Karina’s employer would not accept responsibility for her injuries we took the matter to court and we were able to obtain for Karina fair compensation for her pain and suffering.
Actual Client Testimonial.
I remember the day that I first met Henry. I made an appointment to see him and get some advice on a WorkCover injury. When I walked in the reception staff were very friendly. As I sat in the waiting room, I started to wonder whether I had made the right choice, but as soon as I met Henry I was put at ease with Henry’s very friendly attitude and his compassion - he was very sincere and honest. I explained to him my situation - that I had injured my back at work and the frustration I was experiencing with WorkCover as they ceased paying for treatment a year and a half after my initial injury. Henry went over the day I was injured with me. He asked me about my medical treatment, and he was very thorough. It was never my intention to sue my work place for pain and suffering - all I wanted was for my medical treatment to be funded. Henry explained to me that I was entitled to a claim for pain and suffering and that he believed that I had a strong case. Henry and his team, especially my solicitor Jessica King, were extremely helpful and understanding. Whilst I was going through this process I moved to the United States to be with my boyfriend and whilst I was there, Jessica King and her assistants (particularly Ryan) were constantly keeping me updated and informed with what was going on. When my case finally went to trial, Jessica was extremely helpful and supportive of me in my very vulnerable state. I was extremely emotional during the 11 days of trial but she was very reassuring and supportive. I couldn’t have asked for any better understanding. When the jury finally come to their verdict and awarded me a settlement of $275,000 I was so emotional but extremely thankful for the outcome and very thankful that I had chosen this law firm to represent me. They did an amazing job of presenting my case and my life, probably telling my story better than I ever could. To anyone who is looking for a law firm to represent them, I would say this is the one. Thank you to Henry, Jessica, Ryan and all the other staff. I can’t thank you enough.
