Our client, Jane, was excited to begin her university studies and had secured a casual job at a fast-food restaurant prior to starting classes. Unfortunately, during her employment, she sustained a serious back injury caused by poor work practices and repetitive heavy lifting. Despite her injury, Jane pursued conservative treatment and attempted to continue with her daily activities, including her passion for horse riding. However, the pain persisted, significantly affecting her quality of life. After enduring ongoing discomfort for several years, Jane reached out to our law firm to pursue a workplace injury compensation claim.

The Defendant strongly contested her claim, arguing that her injury was not that bad and that she had managed to maintain most of her regular activities. However, Jane’s persistence in trying to live a normal life—even while in pain—worked in her favour. The Judge accepted Jane’s evidence and found her to be a credible and honest witness. It was accepted that Jane suffered from daily back pain and, given her young age, would likely face long-term consequences. Ultimately, judgement was in her favour, and the Defendant eventually agreed to resolve her common law claim for a fair and just result.

Samim worked for a childcare centre for nearly 10 years and the repetitive heavy lifting of children and changing nappies caused her to tear a muscle in her left shoulder along with damage to her spine. Her injuries took a toll on her, and she developed a severe psychiatric condition. Having not been provided with the correct manual handling training and the correct equipment, her pain was getting worse and Samim was not coping.
