Due to the injuries he sustained in the crash, he remained in hospital for several days and was later advised he would need to use a wheelchair for a number of weeks during his recovery. Although Ms D was able to continue at work, her hobbies were affected, especially arts and crafts needing fine skills with her right hand.  We successfully negotiated a significant common law settlement for Ms D without the need for court proceedings. 

We were also successful in challenging TAC’s decision to cease funding her hand therapy, by making an application to VCAT and having that decision revoked, and meaning that her treatment will continue into the future.

Unfortunately, life threw him another curveball in 2022, when he was involved in a serious rear-end collision on the Monash Freeway in Berwick. While stationary, his car was struck at high speed, pushing it around 15 metres into another lane.

The traumatic incident also resulted in significant psychiatric injuries for Leon and Danning. Danning developed anxiety and depression and now works reduced hours while supporting her family.

On the morning of 18 February 2024, he was riding north on High Street, Bendigo, in the designated bike lane. The road was clear, the weather dry, and traffic moved at a 60km/h speed limit. Without warning, a vehicle struck him from behind, hurling him onto the car’s bonnet, cracking the windshield with his head, and leaving him unconscious on the road. 

The driver fled briefly before returning to the scene, admitting to police they may have fallen asleep at the wheel. Our client remembers nothing of the crash—only waking in the hospital, likely a day later, with no recollection of his family by his side. 

The aftermath was gruelling: three months bedridden in a spinal brace, relentless headaches from a severe concussion, and painful facial and bodily wounds requiring daily care. Wheelchair-bound at first, he now remains with ongoing restrictions. His prized carbon-fibre bike was destroyed in the impact.
