Ms Patel sustained serious physical and psychological injuries after tripping on a dangerous and uneven service cover in a Melbourne footpath. The fall caused significant spinal and ankle injuries, requiring surgery and ongoing treatment, and left her with chronic pain, reduced mobility, and psychological symptoms. As a consequence, Ms Patel was unable to continue working in her profession and experienced a substantial loss of independence, as well as reduced capacity to care for her young children.

The hazard had been present for a prolonged period and had previously been reported yet was never properly repaired. Proceedings were commenced against the infrastructure owner, the local council, and its maintenance contractor.

The claim resolved by settlement on the first day of trial, with all three defendants contributing compensation in recognition of the injuries suffered and their ongoing impact on Ms Patel’s work, family life, and future.

While out for an evening walk with her husband, our client, Helen, suffered a serious fall on a poorly maintained footpath. The area was dimly lit and partially obscured by overhanging trees, making it difficult to see changes in the pavement surface.

As she walked ahead, she unknowingly encountered an uneven section of the footpath and tripped. The fall was sudden and severe. Her husband, who had been walking some distance behind, heard her cry out and rushed to help.

Our client was taken to hospital, where doctors confirmed she had sustained significant injuries to both arms as well as damage to her knees. Surgery was required to stabilise the fractures, and both arms were immobilised during the early stages of her recovery.

The incident dramatically disrupted her independence and daily routine. Simple tasks suddenly became extremely difficult, highlighting just how serious a fall like this can be, particularly when it occurs in a public place that should be safe for the community to use.

Suzanne came to us after reaching a dead end. She had been trying to work out who was responsible for the water asset and roadway where she suffered a serious fall — but found herself stuck in a loop of circular emails between council and various authorities, each pointing the finger at the other.

Lost in that back-and-forth was the person who mattered most: Suzanne. An older woman with a fractured hip, facing urgent surgery and a long recovery.

Our client, John, was completing his usual early morning workout at a gymnasium, when he tripped and fell due to a hazard that was left beneath the matting on the gym floor. John suffered several injuries as a result of the fall and was experiencing increasing pain as a result.

John called our office and was completely unaware of his rights and whether there would be anything that we could potentially do to assist him with his situation. We were more than willing to assist him with his claim, and it was a pleasure to guide John through the legal process.

Deidre had planned a special weekend for her partner to celebrate their 1-year anniversary. They were on their way out for a cheerful meal, and having reached the restaurant, they were being shown to the outside patio area by a staff member to select their table. Unfortunately, there was a single step leading down to the patio, and this step was the same grey colour as the flooring in the patio, making it very difficult to see any difference in height. In fact, the step was almost impossible to detect. It was not highlighted or marked out in any way, and the staff member showing Deidre and her partner to their table did not warn them to mind the step.

As a result, Deidre completely missed the step, fell forward, and seriously jarred her right leg. This resulted in significant damage to her right knee which, sadly, was permanent. Prior, Deidre had worked as a nurse for 30 years and her injuries meant that she had to take early retirement from a job that she loved.

Thankfully, Deidre’s partner took a photo of the step straight after the incident. Over time, as part of our investigations we visited the site and took further photos which proved that, after Deidre’s accident, changes were made to the step including additional markings and a light to illuminate it for customers. This evidence was crucial in ensuring Deidre was able to succeed in her claim.

We were able to resolve Deidre’s matter at a mediation for significant lump sum compensation for her injuries, out of pocket expenses, and loss of income.

Our client, Brigid, sustained a serious spinal injury when she tripped and fell on an uneven footpath. She had just bought a few items at a local food store and was walking home on a July evening at around 5pm. It was getting dark and Brigid tripped on the edge of a raised paving slab. She fell forward and hit her head and face, and her neck was jolted so violently that it caused her spinal cord damage.

Luckily, Brigid’s partner had taken some extremely useful photographs and measurements of the paver before it was repaired. He sent these to the council, accompanying his complaint on behalf of Brigid. In response, the council came out to the site to investigate but said that the defect was less that their intervention level so they would not fix the fault and denied liability for any of Brigid’s injuries or subsequent losses.

Due to the nature of her injuries, Brigid had to undergo significant continuing rehabilitation – the cost of which mostly came from her own pocket.

Our firm was recommended to Brigid by a friend, and we set to work investigating the matter for her. The council maintained their denial of liability, so we issued court proceedings on Brigid’s behalf and were prepared to take her matter to trial if necessary. A few weeks before the trial, the council’s lawyers agreed to settle Brigid’s claim for pain and suffering and out of pocket expenses for a significant sum – an outcome our client truly deserved.

Dorothea was walking through a shopping centre when she suddenly slipped in a small puddle of hand sanitizer, which caused her to fall heavily onto her outstretched arm and her hip. Dorothea suffered multiple fractures in her wrist as a result of the fall and was taken via ambulance to the nearest hospital.

Following her accident, Dorothea reached out to the manager of the shopping centre to see if they were willing to cover the medical expenses that she had incurred as a result of the incident. After having difficulties with the manager, Dorothea reached out to our firm to see if we could potentially assist her with obtaining some coverage of her medical expenses and perhaps a small amount of compensation for the pain and suffering that she had experienced since.

We proceeded to legal proceedings on Dorothea’s behalf, and the claim was vigorously defended by a number of Defendants including: the shopping centre, the shopping centre’s cleaning company, and their relevant insurance companies. Dorothea was at times frustrated by the delays being caused by the Defendants and the legal process in general, however, we made sure that we were always available to answer any of Dorothea’s questions or concerns as quickly as possible.  We took great care to ensure that Dorothea felt supported throughout the legal process and asked that she put her faith in our firm to achieve a positive result for her.

Robert reached out to our office after suffering a significant fall at a train station, resulting in severe injuries. The accident left him in need of multiple surgeries and extended medical treatment. During this challenging time, Robert was primarily focused on his health and recovery. Connie was attending to her grocery shopping at her local supermarket, when she accidentally stepped on a piece of lettuce, causing her to slip and fall heavily. As a result, Connie suffered from a number of injuries and found that she was experiencing increasing pain. Being largely unaware of her rights and hoping to find a simple resolution to the matter, Connie initially reached out to the supermarket to ask for some coverage of her medical bills and perhaps some additional compensation for the pain and hardship she had experienced as result of the fall. The supermarket responded to Connie by stating they were only willing to offer Connie $500.00 in total for both her medical bills and the pain and suffering she had experienced. The money offered was not even enough to cover her medical bills and Connie decided to reach out to our firm for advice.

We investigated Connie’s claim and later initiated contact with the supermarkets insurance representatives by providing evidence as to the severity of the injuries that Connie had suffered because of her fall.  We then engaged in discussions with the insurance company to see if it was possible to find a resolution to Connie’s claim without the need to initiate formal legal proceedings. We endeavoured to hold regular conversations with Connie and her daughter Katrina throughout this process to ensure that we could answer any queries or concerns they might have regarding the claim.

Our client, Wendy, was attempting to disembark from a boat moored at a marina when she slipped and fell, causing her to suffer a nasty fracture to her ankle and further injury to her lower back. Like many people injured in accidents, Wendy had no idea about her legal rights after, and so she contacted our firm to see if there was any way we could possibly assist her with the stressful situation that she had unexpectedly found herself in.
